SymptomIQ Terms of Use

These Terms of Use ("Terms") govern your use of the SymptomIQ mobile application and related services ("SymptomIQ", the "App", or the "Service").

SymptomIQ is provided by [Mode 1 Analytics], based in [35 Oldwood, Oldtown Demesne, Naas, Co. Kildare, Ireland] ("we", "us" or "our").

Please read these Terms carefully. By creating an account or using SymptomIQ, you agree to these Terms.

If you do not agree to these Terms, you should not use the Service.

1. About SymptomIQ

SymptomIQ is a health-tracking and informational tool designed to help you record and review information such as:

symptoms;
food and drink;
stress;
routines and other factors that may be relevant to your wellbeing; and
patterns or associations identified from the information you record.

SymptomIQ may analyse your logged information and present insights intended to help you better understand patterns in your own data.

SymptomIQ is designed to support personal health awareness. It is not a medical diagnostic or treatment service.

2. SymptomIQ Does Not Provide Medical Advice

SymptomIQ does not provide medical advice, medical diagnosis or medical treatment.

Information, patterns, observations and insights presented by SymptomIQ are provided for general informational purposes only.

In particular:

an association identified by SymptomIQ does not necessarily mean that one factor caused another;
insights depend on the information you choose to record and may be incomplete or inaccurate;
insights may change as additional information is recorded;
SymptomIQ cannot take account of all factors that may affect your health; and
SymptomIQ does not replace the judgement of a qualified healthcare professional.

You should not use SymptomIQ as the sole basis for making decisions about medical treatment, prescribed medication, significant dietary changes or other decisions that could affect your health.

Where appropriate, discuss information from SymptomIQ with your GP, doctor, pharmacist or another appropriately qualified healthcare professional.

Using SymptomIQ does not create a doctor-patient, clinician-patient or other healthcare professional relationship between you and us.

3. Emergencies and Urgent Medical Concerns

SymptomIQ is not an emergency service and should not be used to assess or manage a medical emergency.

If you believe that you or another person may be experiencing a medical emergency or require urgent medical attention, contact the appropriate emergency or healthcare service immediately.

Do not delay seeking medical attention because of information displayed by SymptomIQ.

4. Eligibility

You must be 16 years of age or older to create and use a SymptomIQ account unless we expressly provide a version of the Service that supports younger users in accordance with applicable law.

By creating an account, you confirm that you meet the applicable age requirement and that you have the legal capacity to agree to these Terms.

5. Your Account

Some features of SymptomIQ require an account.

You are responsible for:

providing accurate information when creating your account;
keeping your account details reasonably up to date;
maintaining the security of your account and any devices through which you access SymptomIQ; and
notifying us if you believe your account has been accessed without your permission.

You must not create an account using another person's identity or intentionally provide false or misleading account information.

Where third-party sign-in services such as Google or Apple are available, your use of those services may also be subject to the relevant provider's terms.

6. Information You Record

You decide what information to record in SymptomIQ.

You remain responsible for the accuracy and completeness of information that you enter.

Because SymptomIQ's insights are based on the information available to it, missing, incorrect, inconsistent or incomplete logging may affect the usefulness or accuracy of those insights.

You retain any rights you have in the information that you submit to SymptomIQ.

You permit us to store, process and analyse that information only to the extent necessary to provide, maintain, secure and improve the Service and for other purposes described in our Privacy Policy and permitted by applicable law.

7. Privacy and Health Data

Your privacy is important to us.

Our Privacy Policy explains how we collect, use, store, protect and delete personal data, including health-related information.

The Privacy Policy forms an important part of your relationship with SymptomIQ and should be read alongside these Terms.

Where we ask for your consent to a particular type of processing, that consent is separate from your agreement to these Terms.

Where processing of your personal data relies on your consent, you may withdraw that consent in accordance with our Privacy Policy and the controls available within SymptomIQ.

Withdrawal of consent will not affect processing that lawfully took place before the consent was withdrawn.

If the processing covered by a withdrawn consent is necessary for SymptomIQ to provide the Service, we may no longer be able to provide your account or some features of SymptomIQ. Where appropriate, this may result in closure of your account and deletion or other handling of your data as described in our Privacy Policy.

8. Your Responsibilities When Using SymptomIQ

You agree to use SymptomIQ only for lawful purposes.

You must not:

attempt to gain unauthorised access to SymptomIQ, another person's account or systems connected to the Service;
interfere with or disrupt the operation or security of the Service;
use automated systems to access or extract information from SymptomIQ except where we expressly permit this;
introduce malicious software, code or other harmful material;
use SymptomIQ to infringe another person's rights;
attempt to circumvent security, access or usage restrictions;
impersonate another person;
use SymptomIQ for unlawful, fraudulent or abusive purposes; or
reproduce, copy, modify, distribute or commercially exploit the Service except where permitted by law or expressly authorised by us.

Nothing in these Terms prevents you from exercising rights that cannot lawfully be restricted.

9. Pilot and Early-Stage Features

SymptomIQ may from time to time make features available as part of a pilot, beta, preview or early-access programme.

Pilot features are intended to allow us to evaluate and improve the Service.

During a pilot:

features may change;
features may be added, removed or redesigned;
availability may be limited;
some features may not operate as expected;
the format or presentation of insights may change; and
we may ask users for voluntary feedback.

Pilot status does not affect any rights that you have under applicable consumer, privacy or other laws.

Where personal data is used during a pilot, it will continue to be handled in accordance with our Privacy Policy and applicable data-protection law.

10. Insights and Automated Analysis

SymptomIQ may use automated rules, statistical analysis, algorithms or other computational methods to identify patterns within the information you record.

These may include observations about timing, frequency, repeated behaviours, symptoms or potential associations between different types of logged information.

Insights are intended to help you explore your data. They should not be interpreted as proof that a particular food, behaviour, event or other factor caused a symptom or health outcome.

Different people can respond differently to the same factors, and patterns identified from your own logged information may have alternative explanations.

We may change or improve the methods used to generate insights over time.

11. Third-Party Services

SymptomIQ may rely on third-party services to provide certain functionality.

These may include services used for:

account authentication;
secure data storage;
app infrastructure;
notifications;
analytics;
distribution through app stores; and
other technical functions required to operate the Service.

Where appropriate, information about third parties that process personal data on our behalf will be provided in our Privacy Policy.

Your use of services provided directly by a third party may also be subject to that third party's own terms and privacy practices.

12. Apple App Store and Google Play

This Terms of Use agreement governs your use of SymptomIQ, including the App, your account, and the services and features we provide through SymptomIQ.

If you download SymptomIQ through the Apple App Store or Google Play, certain additional terms of the relevant app-store provider also apply where they relate to distribution of the App, licensing, payments, subscriptions, refunds, or other matters handled by that provider.

If you download SymptomIQ from Apple’s App Store, your licence to use the iOS application is also subject to Apple’s Standard End User License Agreement (EULA).

Where there is a conflict between this Terms of Use agreement and mandatory terms of the relevant app-store provider in relation to a matter handled by that provider, those provider terms will apply to that matter.

Nothing in these Terms is intended to remove or restrict rights or protections available to you under applicable law.

13. Changes to SymptomIQ

We expect SymptomIQ to develop over time.

We may:

introduce new features;
change existing features;
discontinue features;
change how information or insights are presented;
update technical requirements; or
make changes necessary for security, legal or regulatory reasons.

Where a change materially affects your rights or the nature of the Service, we will provide appropriate notice where required by law.

We do not guarantee that every feature will always remain available.

14. Service Availability

We aim to provide a reliable Service but cannot guarantee uninterrupted availability.

SymptomIQ may occasionally be unavailable because of maintenance, updates, technical problems, failures involving third-party services or circumstances outside our reasonable control.

Where reasonably possible, we will work to restore the Service and protect the integrity of user information.

15. Intellectual Property

SymptomIQ, including its software, design, branding, graphics, written content and other materials created by or for us, is protected by intellectual-property laws.

Except for the limited right to use the Service in accordance with these Terms, no ownership rights in SymptomIQ are transferred to you.

You may not use our name, branding, logos or other protected materials for commercial purposes without our prior written permission.

This section does not apply to information that you enter into SymptomIQ yourself.

16. Feedback

We may invite you to provide feedback about SymptomIQ.

Providing feedback is voluntary.

If you provide suggestions, comments or ideas about improving SymptomIQ, you agree that we may use that feedback to develop or improve the Service without being required to compensate you.

This does not give us ownership of your personal health information or other personal data.

17. Deleting Your Account

You may request deletion of your SymptomIQ account using the account deletion functionality provided within the App or by contacting us where appropriate.

When an account is deleted, associated personal data will be deleted, anonymised or otherwise handled in accordance with our Privacy Policy, applicable law and any legitimate retention requirements.

Deletion may not always be instantaneous where limited information must temporarily be retained for security, legal, fraud-prevention, audit or regulatory reasons.

Where information must be retained, we will only retain what is necessary for the applicable purpose and period.

18. Suspension or Termination by Us

We may restrict, suspend or terminate access to SymptomIQ where reasonably necessary, including where:

you seriously or repeatedly breach these Terms;
we reasonably believe an account is being used unlawfully or fraudulently;
continued access presents a security risk;
we are required to do so by law; or
the Service or relevant pilot programme is being discontinued.

Where appropriate and legally permitted, we will provide reasonable notice.

Nothing in this section affects any rights you may have under applicable consumer law.

19. No Guarantee of Particular Health Outcomes

We do not promise that using SymptomIQ will improve a particular symptom, condition or health outcome.

We also do not guarantee that SymptomIQ will identify every meaningful pattern within your data or that every pattern it identifies will ultimately prove relevant to your health.

Your experience will depend on many factors, including the information recorded and circumstances outside the scope of the Service.

20. Our Responsibility to You

We will provide SymptomIQ with reasonable care and skill and in accordance with obligations that apply to us under law.

Nothing in these Terms excludes or limits liability where it would be unlawful for us to do so.

In particular, these Terms do not exclude or restrict any mandatory rights or remedies available to you under applicable consumer law.

To the extent permitted by law, we are not responsible for losses that:

were not reasonably foreseeable when you began using the Service;
result from use of SymptomIQ contrary to these Terms or the guidance provided within the Service;
arise because information entered into SymptomIQ was inaccurate or incomplete;
result from relying on SymptomIQ as a substitute for professional medical advice; or
arise from events outside our reasonable control.

Nothing in this section is intended to exclude liability that cannot lawfully be excluded, including liability where applicable law specifically prohibits such an exclusion.

21. Your Consumer Rights

If you use SymptomIQ as a consumer, you may have statutory rights under Irish and European Union consumer law.

These Terms do not replace, restrict or exclude those rights where they cannot lawfully be limited.

If there is a conflict between these Terms and a mandatory consumer protection that applies to you, the mandatory protection will apply.

22. Charges and Paid Features

Some SymptomIQ features require a paid subscription. Available subscription plans, prices, billing periods and any applicable free trial or introductory offer are shown before you subscribe.

Where you purchase a subscription through the Apple App Store or Google Play, payment is processed by the relevant app-store provider. Your subscription will renew automatically unless cancelled in accordance with that provider’s subscription terms.

You can manage or cancel an app-store subscription through the subscription-management settings provided by Apple or Google, as applicable.

We may change the features included in subscription plans or offer different plans in the future. Any changes to pricing or renewal terms will be handled in accordance with applicable law and the rules of the relevant app-store provider.

Nothing in this section affects any cancellation, refund or consumer rights available to you under applicable law.

23. Changes to These Terms

We may update these Terms from time to time, for example because:

SymptomIQ changes;
new features are introduced;
legal or regulatory requirements change; or
we need to clarify how the Service operates.

The latest version will show its effective date at the top of this document.

If a change materially affects your rights or obligations, we will provide reasonable notice or request renewed acceptance where appropriate or required by law.

Changes will not retrospectively remove rights that you have already acquired under applicable law.

24. Governing Law

These Terms are governed by the laws of Ireland.

If you are a consumer living elsewhere in the European Union or another jurisdiction that provides mandatory local consumer protections, you may also benefit from rights under the laws of your country of residence.

Nothing in these Terms requires you to give up any right to bring a claim in a court or jurisdiction available to you under applicable law.

25. If Part of These Terms Is Invalid

If a court or competent authority decides that a provision of these Terms is unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
